N\u00e5 viser det seg at 3D Realms aldri hadde retten p\u00e5 sin side n\u00e5r det gjelder Duke Nukem-navnet, noe som har f\u00f8rt til at eierne av merkenavnet &#8211; Gearbox Software &#8211; n\u00e5 har g\u00e5tt rettens gang mot selskapet.<\/p>\n<h5>Feilsl\u00e5tt fors\u00f8k?<\/h5>\n<p>3D Realms solgte nemlig merkenavnet til Gearbox s\u00e5 tidlig som i 2010, og s\u00f8ksm\u00e5let (som kan leses <a href=\"http:\/\/www.scribd.com\/doc\/208673755\/Gearbox-v-Apogee-d-b-a-3D-Realms-Interceptor-2014-Filed-Complaint\">her<\/a>) bunner i at de har pr\u00f8vd \u00e5 overbevise andre om at salget aldri skjedde, og at den ubevilgede utviklingen av Mass Destruction har kommet som en f\u00f8lge av dette.<\/p>\n<\/p>\n<p>Dette er ikke f\u00f8rste gangen de to kamphanene er i tottene p\u00e5 hverandre; i fjor gikk s\u00f8ksm\u00e5let motsatt vei, og Gearbox ble anklaget for ikke \u00e5 ha betalt nok i anledning Duke Nukem Forever. Det var imidlertid 3D Realms som endte opp med \u00e5 unnskylde seg den gangen, noe de ogs\u00e5 har gjort i denne saken. Blant rettsdokumentene finner vi nemlig en <a href=\"http:\/\/www.scribd.com\/doc\/208673771\/Gearbox-v-Apogee-d-b-a-3D-Realms-Interceptor-2014-Exhibit-D\">anerkjennelse<\/a> av feilgrepet signert av b\u00e5de 3D Realms-sjef Scott Miller og Duke Nukem-skaperen selv, i tillegg til <a href=\"http:\/\/www.scribd.com\/doc\/208673770\/Gearbox-v-Apogee-d-b-a-3D-Realms-Interceptor-2014-Exhibit-C\">anklagelsen<\/a> fra Gearbox.<\/p>\n<p>Med det kan det se ut som om det ikke ender s\u00e6rlig stygt denne gangen heller, og i en uttalelse kaller Gearbox saken for uheldig for Duke Nukem-fansen.
